Business Licenses by City: How the Biggest Cities License

In most of the country the license that lets you open the doors comes from city hall, not the state capitol. But no two big cities run licensing the same way: some license every business, some license none generally and regulate by activity, and several fold the license into the local tax system. These guides cover the largest markets one city at a time, and each pairs the city layer with the state requirements that sit above it.

Why the city layer is the confusing one

State licensing is at least documented in statute. City licensing is written in municipal codes, administered by departments with different names in every city, and often disguised as a tax registration rather than a license. The result is that the same question, does my business need a license here, has a different answer in New York than in Chicago, and a different issuing office in Los Angeles than in Philadelphia. The honest framing matters: city licenses are issued by the city to the operator, usually online and quickly, and no outside service can skip that step for you. The three city licensing models

Big cities cluster into three models. Tax-certificate cities, Los Angeles, Philadelphia, Seattle, and Atlanta among them, require every business to register with the city's finance or revenue office and treat the certificate as the license. General-license cities, Chicago is the clearest example, issue a true business license with an application and review. And no-general-license cities, New York and Houston, license nothing across the board but regulate dozens of specific activities, so whether you need a city license depends entirely on what the business does.

The state layer still applies

Whatever the city requires, the state layer runs in parallel: entity registration with the secretary of state, a seller's permit or sales tax registration with the revenue agency, and industry licenses for regulated fields. A business can be perfectly licensed with the city and still be operating unlawfully at the state level, and the reverse. Texas

Frequently asked questions

Is a city business license the same as a state business license?

No. They are separate layers issued by separate governments. Some states have a general state license or registration and most cities have their own requirement; a business inside city limits typically needs both layers, and neither substitutes for the other.

Do online businesses need a city business license?

Usually the city where the business physically operates, including a home office, is the city whose rules apply. Selling online into a city from elsewhere generally does not trigger its license, though it can trigger state-level sales tax registration.
