# Does a lender also need a money transmitter license?

## Short answer

Not for lending itself. Making loans and receiving repayments on your own loans is lending, not money transmission, so a lending license is the right authorization for that activity. The money transmitter question appears when a lender starts moving other people's money: servicing or collecting loans owned by third parties and passing the funds through, disbursing loan proceeds on behalf of other lenders, running a payments feature alongside the loan product, or operating a marketplace where funds flow between investors and borrowers.

Money transmission statutes cover receiving money from one party for transmission to another. A balance-sheet lender does not do that: the borrower's repayment belongs to the lender, so no third party's funds are in transit. That is why a licensed consumer or commercial lender does not automatically need a money services business license, and why the two license families are administered separately even in states where the same regulator issues both.

The overlap cases are structural. A servicer that collects payments on loans owned by someone else is holding and forwarding third-party funds, and several states analyze that flow under their money transmission statutes unless a servicing exemption applies. Marketplace and fintech platforms that move investor money to borrowers and payments back to investors sit squarely in the transmission analysis, which is one reason many platforms route funds through a bank partner instead of touching them. Wallet features, bill-pay add-ons, and disbursement services offered around the loan product each get the same treatment: the question is always whose money is moving and who holds it in transit.
