# Are stocks considered digital assets? *Reviewed 2026-07-31* ## Short answer Generally no. A stock held in a brokerage account is a traditional security that happens to be recorded electronically; the electronic record is a bookkeeping convenience, not the asset itself. In regulatory usage, "digital asset" refers to assets whose existence and transfer are natively digital, typically recorded on a blockchain or distributed ledger, like cryptocurrency, stablecoins, and tokenized instruments. A tokenized stock issued and transferred on a blockchain is the exception: that is both a security and a digital asset. The distinction is about where the asset lives. Your Apple shares exist as entries in the traditional clearing and custody system (DTCC, transfer agents, brokerage books); digitizing the record does not change the asset's legal nature or its regulator. Digital assets in the regulatory sense are natively digital: the ledger entry is the asset, and moving it means writing to the ledger. The line matters because it decides which regime applies. Holding or exchanging customers' cryptocurrency is money transmission in most states and can trigger dedicated regimes like the New York BitLicense.
